Booking Agreement
1. The following terms and conditions constitute a legally binding contract (hereinafter - “Terms and Conditions”) between you (“you” or “your”) and Travel Drive GmbH, Swiss based corporation with the registration number: CHE-132.261.137, and legal address: Baarerstrasse 110a, 6300 Zug, Switzerland, that governs all use by you of the www.discovercars.com website or mobile application (hereinafter - the "Website") and the services available on or at the Website (taken together with the use of the Website - hereinafter “Services"). We’ll refer to Travel Drive and all of its affiliated companies collectively as "Travel Drive", "we", "our", "us", “Company”, etc.
2. Travel Drive is providing travel arrangements, and is one of the leading companies in its segment of the travel sector worldwide, servicing customers interested in holidays containing car rental. Travel package provided by Travel Drive, in addition to car rental, might include customer support and professional consulting on choosing the best holiday rental vehicle for the Customers, consulting about the procedure of simpler booking and easiest vehicle collection and vehicle return procedures, informational and tour guiding services (e.g. travel information about the destination and entry requirements, advice on sightseeing, restaurants, hotels, beaches, maps etc.), concierge services related to travel destinations, “last-minute” cancellation services for best travel experience with the Company and other travel related services(hereinafter - the “Travel Package”).
3. Please read these Terms and Conditions carefully before using the Website or any of our Services. The Services that are offered subject to your acceptance without modification of all of the Terms and Conditions contained herein. Your use of the Website constitutes your acceptance of and agreement to be bound by the Terms and Conditions. By placing an order for the Travel Package from the Website, You accept and are bound by the Terms and Conditions. If You are not buying the Travel Package from the Company, You still have to comply with the Terms and Conditions for duly usage of the Website. If You do not agree to any statement of these Terms and Conditions, you must not use this Website or any Services provided by the Company.
4. By using the Services provided on the Website and sending its booking data (including but not limited to travel days, locations, etc.) and accepting the Terms and Conditions, You submit a legally binding offer to enter into the agreement between yourself and Travel Drive (hereinafter - the “Booking Agreement”). By entering into the Booking Agreement with the Company, You become the client of the Company (hereinafter - the “Customer”). After approval of the Company on the availability of the requested Services in accordance with the binding offer of the Customer, the Company and the Customer enter into the Booking Agreement for the Travel Package Services (including car rental and the provision by the Company of additional services relevant to travel, if any) that the Customer can utilize for the duration of the Booking Agreement.
5. Booking Agreement includes terms and conditions disclosed in the Terms and Conditions as well as binding offer specific information relevant for Travel Package delivery by the Company to the Customer. The Customer will receive booking information and documents (hereinafter - the “Voucher”) and access data for the individually provided services under Travel Package relevant to travel with the Voucher.
6. The Booking Agreement between the Company and the Customer is considered concluded when (a) the Customer has booked the Service on the Website, (b) corresponding booking details, i.e. the Voucher is sent to the Customer.
7. The Company is the primary provider of the Travel Package to the Customer, acting in its own name and facilitating the Booking Agreement directly between the Customer and the Company for the provision of the Travel Package services.
8. The Company provides the Customer with the information regarding available Travel Packages (with underlying car rental providers, types of car, locations, reservation dates and time, rental terms, available tour guides and concierge services (if any), etc.) and sending the Voucher to the Customer via email after availability of all elements of the Travel Package (incl. car rental) have been confirmed to be available on the requested period and location.
9. The Company has a wide network of the car rental companies that are engaged in fulfilment of Company’s obligation under the Booking Agreement concluded between the Company and the Customer, at the Customer’s destination. The Company does not operate car vehicle fleet and does not provide car rental services itself, but arranges that an underlying car rental company provides these services to the Customer in an accordance with the Travel Package. The Customer therefore is obliged to hand over the Voucher issued by the Company to the car rental company engaged in provisioning of Travel Package by the Company when the Customer collects the vehicle.
10. On the Website, the total price of the Travel Package is visible before choosing a payment method and entering payment information and stands for all service elements altogether provided by the Company incl. car rental and additional travel services (hereinafter - the “Travel Package Price”). The Customer might be able to add additional travel services to the Travel Package before vehicle pick-up (with corresponding additional payment).
11. It is therefore important for the Customer to be aware that by entering his/her payment details (or making a payment using PayPal, GooglePay or ApplePay) and approving the payment, the Customer has expressed the wish to conclude the Booking Agreement and that this Booking Agreement can be cancelled only in accordance with the conditions of this Booking Agreement or locally applied laws.
12. Following the entry into force of the Booking Agreement, the funds (in the amount calculated according to the section “Payments” of this Terms and Conditions and the payment procedure of the chosen Travel Package) might be deducted and transferred to the bank account of the Company. A Voucher will be sent to the Customer via email as confirmation that the Booking Agreement has been concluded.
13. You must read the Terms and Conditions before paying for the Travel Package and concluding the Booking Agreement. If the meaning or consequences of the Terms and Conditions are not clear to You, it is strongly recommended that You contact the Company via email: support@discovercars.com to get additional information about the Terms and Conditions prior to accepting them.
14. The Customer must contact the Company via abovementioned email about all inquiries related to the Travel Package to sort all possible misunderstandings, modifications and issues, including if Travel Package’s parts are at risk of being properly provided and are not related to the misuse/misbehaviour/incomplying with Terms and Conditions or car vehicle company’s rental conditions by the Customer (for example, absence or wrong class of car vehicle, heavily damaged car, absence of tour guide on location (if included), etc.). Please prior contacting the Company read fully the Terms and Conditions and governing principles set in all paragraphs.
BOOKING
15. On the Website, You can select and book various Travel Packages created and offered by the Company on its own behalf to You and containing multiple travel related services that are provided by the Company itself or in collaboration with a range of different service providers, e.g. the Company is outsourcing car rental element of the Travel Package to the wide network of the car rental companies around the globe.
16. The Customer must sign all necessary documents (including documents that regulate acceptance and usage of the car, including rental agreement) with the car rental company at the time of picking up the booked car in accordance with the car rental company’s car rental and usage conditions. By issuing the Voucher the Company confirms that the Travel Package has been arranged and that the Customer has the right to collect the car and sign the relevant documents with the car rental company.
17. Each car rental company has its own rental conditions for car pick up and its use. Nevertheless, the main conditions of the car rental companies regarding driver requirements, insurance, deposit, payments, fuel policy, etc. offered by the car rental company are available in the “Rental Conditions” section on the Website. Complete applicable rental conditions of the car rental company are available at pick up.
18. The Company provides car rental company’s rental conditions to the Customer solely for informational purposes and for smooth travel experience, the Customer must read and be able to comply with rental conditions of the particular car rental company. The Company displays rental conditions on the Website as approved by the car rental company at the current time. However, the Company assumes no responsibility with regard to the Customer if the rental conditions or terms and conditions of the particular car rental company change.
19. Detailed information regarding the Customer’s particular booking is provided in the Voucher sent to the Customer via email.
20. The main currencies in which prices are published on this Website are euros (EUR), United States dollars (USD), Canadian dollars (CAD), and British pounds (GBP). There is an option to view prices in other currencies and they will be shown converted based on the daily updated currency exchange rate according to the foreign exchange reference rates published by the European Central Bank. In the case of Full prepayment bookings (as described below), the principal currency is determined by the car rental company in its respective country and converted accordingly.
BOOKING CREATION PROCESS
21. To make a booking, You shall choose the required Travel Package, which includes car rental of specific car class. The booking does not guarantee a specific car make or model, but a chosen class of car unless it is specifically mentions the specific car model and marked as guaranteed by the car rental company. If the booked car class is available at pick-up time, it will be provided. In other cases, a car of the same or higher class will be provided. Infrequently, only cars of an inferior class can be provided.
22. Pictures of cars shown on the search page are informative. The rented car provided at pick up may differ from the one in the picture.
23. It is Your responsibility to carefully review all information provided about the selected Travel Package and car class as the rental conditions of the underlying car rental company may vary.
24. You must make sure that the driver’s age is within the provider’s specified age limit. The Company cannot be responsible if upon picking up the car, the Customer (or any of drivers) does not meet the requirements of the car rental company.
25. Information regarding options and extras included and excluded from the Travel Package Price is available on the Website under the sections “Rate Includes”, ”Rate Excludes” and in the section ”Optional Extras and Services”. Charges for any additional services made by the Customer with the car rental company in addition to the Booking Agreement at the destination are not included in the Travel Package Price. The Customer enters into such agreements exclusively in their own name and independently of the Booking Agreement. The Customer is expressly not granted power of attorney authorizing agreements for additional services to be entered into in the name and for the account of the Company.
26. If additional extras, such as GPS, child seats, or bicycle racks, the possibility to travel outside the pick-up country, the possibility to drop off the car in a location other than the pick-up location and/or the option to pick up the car in a place other than the rental office, are needed, this must be specified in writing at the time of booking or via email: support@discovercars.com or live chat on the Website.
27. When a booking is made, the Company proceeds with confirmation of availability of all components of the Travel Package requested by you, incl. obtaining confirmation of the availability of car rental service element with the car rental company that is involved in delivery of Travel Package under selected booking. Depending on various factors, the confirmation process can take up to 48 hours. If the start date of the rental period is 5 days or less from the booking date, the booking will be processed as a priority.
28. When availability of all Travel Package elements is confirmed by the Company (including the chosen car rental element with the car rental company that it can offer the requested vehicle), the Company charges/withholds the Travel Package’s Price in full or partly depending on payment conditions for this Travel Package (including the price for additional services payable to the Company, if any) from the credit card and sends the confirmation Voucher which completes the booking confirmation process.
29. If any of the Travel Package elements is unavailable, a representative of the Company will contact You to offer possible alternative bookings.
30. If any of the Travel Package elements the car is unavailable and offered possible alternative bookings are accepted by You or there is no alternative bookings to be offered to You by the Company, the Company will cancel the booking and remove the reservation of funds corresponding to the price of the Travel Package from the Customer’s payment card.
31. The status of the booking made by the Customer can be viewed on the Website by going to the "My Booking" section.
PAYMENTS
32. The payment methods accepted by the Company on the Website are valid credit/debit cards, PayPal, ApplePay and GooglePay.
33. Payments for the Service are processed either directly by the Company or through its authorized affiliates (such as Car Rental Technologies – FZCO, UAE and or Discover Car Hire AS - Latvia).
34. Some of payment methods might require for practical reasons, that the Customer pays some or full part of the Travel Package Price directly to the car rental company on behalf of the Company. Regardless of how the payment is processed, the Company remains the dedicated Travel Package provider to the Customer as principal in its own name and the Customer consents that all Customer’s payments (even if paid directly to the car rental company ) are considered as payments of Travel Package Price to the Company.
35. For the payment methods, that require for practical reasons, that the Customer pays some or full part of the Travel Package Price directly to the car rental company, the payment methods accepted by the car rental company may vary and can include credit cards, debit cards, and cash. Please note that some car rental companies only accept credit card payments. The Customer is obliged to check the payment methods indicated for chosen Travel Package offering (available on the Website in the “Rental Conditions” section) himself/herself prior to making the booking and arriving to pick up the car.
36. The Company can provide the Customer with the following types of payment for the Travel Package (taking into account that all payments from the Customer are considered as payments to the Company for Travel Package Price):
36.1. The Company collects from the Customer part of Travel Package Price as the prepayment when making a booking. The Customer pays the rest of the Travel Package Price, as well as any payment for chosen extras and additional services, directly to the car rental company when collecting the car at the destination (hereinafter - the “Partial prepayment booking”).
36.2. The Company collects from the Customer the full price of the Travel Package Price (hereinafter - the “Full prepayment booking”) as the prepayment when making a booking.
36.3. The Company does not collect any payment from the Customer when the booking is made. The Customer pays the Travel Package Price, as well as payments for extras and additional services chosen by the Customer, directly to the car rental company when collecting the car at the destination (hereinafter - the “Pay on arrival booking”).
37. The payment type available for the particular booking made by the Customer depends on the particular Travel Package.
38. Payment deducted by the Company consists of the Travel Package Price (or its part) as well as payments for any chosen Full Coverage service (if chosen in accordance with the Full Coverage section of these Terms and Conditions), which might be added into Travel Package Price, if bought.
39. Payments for additional extras and services chosen at the time of pick-up are not withheld by the Company and are charged by the particular car rental company upon picking up the car.
40. Obligations between the Customer and car rental company under the car rental agreement that is formed while picking up the car are not governed by the Booking agreement.
41. A security deposit under car rental agreement, concluded between the Customer and car rental company while picking up the car, is held on the Customer’s or the main driver’s credit card or a cash deposit is taken by the car rental company to cover the costs of possible insurance excess/deductible, traffic violations, refueling costs, etc. Security deposit is not governed by the Booking agreement. If no traffic violation costs or any other costs occur, the security deposit held on the credit card lapses, usually within 3 weeks from the end of the rental period
42. Payments to the car rental company (if applicable) must be made in the local currency of the country where the car is to be picked up. If this currency is different from the currency of the Customer’s credit card, the credit card company will perform a currency exchange at its established rate and may also charge the card for a conversion fee. The Company is not responsible for discrepancies between the price shown on the Website and the amount for which the Customer’s credit card is charged if these discrepancies are due to the currency exchange rate used or the conversion fee applied or if the Customer and the car rental company have agreed on a higher price than the Rental Price determined in the booking confirmation.
43. The car rental company can request pre-authorization on the credit card for the amounts mentioned in paragraphs 41 and 42 before allowing the Customer to pick up the car.
RIGHT TO WITHDRAW
44. After entering into the Booking Agreement, the Customer has no right to withdraw from the Booking Agreement (unless specifically allowed by the Booking Agreement) according to the laws of Switzerland.
CANCELLATION AND REFUND POLICY
45. The Customer can cancel the booking and get a credit that can be used towards future bookings on the Website (hereinafter - the “Booking Credit”) up to 48 hours before the originally scheduled pick-up time, through the My Booking section of the Website.
46. If cancellation is requested less than 48 hours before the originally scheduled pick-up time, only the cost of Full Coverage (if added within Travel Package) will be provided in Booking Credit.
47. No refund will be given if cancellation is requested after the originally scheduled time of pick-up.
48. Prices are based on the pick-up and drop-off dates and times arranged prior to the commencement of the rental.
49. If the car is picked up from the car rental company any later or brought back any earlier, the Customer will not receive a refund for the unused hours or days.
50. If the booking is made less than 48 hours before the pick-up time, it is non-refundable (Full Coverage, if added within Travel Package, is refundable up until the pick-up time).
51. If the Customer does not intend to pick up the car (even if no refund is available), the Customer shall notify the Company at once; otherwise, the Customer may be charged an additional no-show fee.
52. If a cancellation request is made to the car rental company and not to the Company, this Cancellation and Refund Policy shall not be applicable.
53. The Booking Credit can be used for any payment made on our Website and can be used for one or multiple bookings. The Booking Credit can only be used to pay for Company’s Services and only in case of the direct payment to the Company or its affiliates.
54. The Booking Credit will expire three (3) years after the Customer receives it.
55. The Customer can see the amount of available Booking Credit by going to the “My Booking” section of the Website and using the Customer’s original booking number and email address.
56. The Customer can recover their original booking number by contacting the Company’s Customer Support team and asking for assistance.
57. Depending on the circumstances surrounding the cancellation, the Company may offer an extra amount of Booking Credit on top of the original amount paid for the canceled booking.
58. The Company reserves the right to award Booking Credit to the Customer based on their loyalty to our Company and its services, for special events (public holidays, international events, etc.), on the Customer’s birthday, and in other circumstances at Company's discretion. Such awards may be offered to both subscribed and non-subscribed Customers, and may be subject to the Terms and Conditions or to the specific terms that we establish from time to time for particular awarded Booking Credits (such as having an expiration date, type of rental it can be used for, etc.).
59. The Customer can use their Booking Credit for any new booking or payment made on the Website.
60. To use Booking Credit, the Customer should use the same email address that was used for the original booking in the driver details section. The Booking Credit will be automatically applied to the new booking’s total amount.
61. If the payable amount for a new booking is less than the Customer’s available Booking Credit, the Customer will be able to use the leftover amount in the same manner for a future booking.
62. The Customer may request reimbursement in money of any leftover amount of what was originally paid up to one (1) year after receiving the Booking Credit. This does not apply to the extra or bonus added to the original amount paid or to any Booking Credit awarded to the Customer in accordance with paragraph 57 of these Terms and Conditions. For the purpose of refunds, the amount originally paid will be deemed to have been used first.
63. Any refund due for a canceled booking that was paid for, either partially or fully, using Booking Credit shall be issued in the form of the Booking Credit.
64. The Company reserves the right to not issue Booking Credit nor a money refund for any transaction that is deemed to not have been made in good faith with the intention to rent a vehicle (e.g., transactions made for the financial benefit of the Customer).
NO-SHOW
65. If no information is given to the Company about the cancellation of the booking 48 hours before the pick-up time, and the Customer does not arrive in time to the pick up location of the car rental company, it will be classified as a no-show and an additional no-show fee may be charged in the amount, equal to underlying car rental company’s tariffs for no-show. In the event of no-show, the Travel Package for the Customer is being cancelled by the Company without refund of the paid amount.
66. The Company has right to charge a no-show fee and to not refund any payment (including for a Full prepayment booking) made by the Customer in the event of a no-show. The following situations are considered no-shows:
66.1. The Customer fails to pick up the car at the time and date specified in the Voucher without notifying the Company 48 hours in advance;
66.2. The Customer fails to provide the documentation required to pick up the car (specified in Rental Conditions of each car rental company);
66.3. The Customer fails to provide an acceptable method of payment and an acceptable form of a security deposit, usually a credit card in the main driver’s full name with enough available funds, no additional restrictions, and valid for at least 2 months after the drop-off date; or
66.4. The Customer is denied the vehicle due to being blacklisted or if the Customer arrived under the influence of alcohol or drugs.
67. The car rental company reserves the right to refuse pick-up to any Customer who fails to arrive at the scheduled time and date with all necessary documentation, an acceptable method of payment, and acceptable form of a security deposit, usually a credit card in the main driver’s full name with enough available funds to cover the security deposit or if the Customer arrives at the car rental desk under the influence of alcohol or drugs.
MODIFICATIONS
68. The Customer can modify their booking preferences by submitting a request via the My Booking section of the Website no later than 48 hours before the pick-up date/time. Modification requests received less than 48 hours before the pick-up date/time will not be processed and the Company is not responsible for any loss or damages suffered by the Customer in this case.
69. The modification service itself is free of charge, but any modification such as an amendment of the pick-up or drop-off location, car group, rental period or driver’s personal details etc. may affect the Travel Package Price causing it to differ from the Travel Package Price indicated in the initial confirmation Voucher.
70. If a booking’s date and/or time is modified later than 48 hours prior to the original pick-up time, no refund will be given for the costs of the Travel Package.
71. The Company cannot guarantee the processing of modifications. Any modification requested by the Customer shall come into effect only after written confirmation by the Company. If the Company has not accepted (in written form) the modification requested by the Customer, the conditions previously confirmed by the Company and the Customer apply. If the Customer subsequently wishes to have changes made to the Booking Agreement, e.g. the rental or return date, the vehicle category, the place where the vehicle is to be collected or returned, this change must also be requested from and confirmed by the Company. If such changes are not confirmed, the Customer alone bears any consequences.
72. If any difficulties arise with the vehicle booking, the rental vehicle, the additional services relevant to travel, etc. (referred to as service disruptions), the Customer should contact the Company (by post to Baarerstrasse 110a, Zug, Switzerland, 6300, or per e-mail to support@discovercars.com or via LiveChat on the Website) without delay for proper assistance to ensure that the Booking Agreement can be fulfilled.
73. The Company will not take responsibility for modifications arranged directly between the car rental company and the Customer.
PICKING UP THE CAR
74. The Customer must present the following original documents (not copies) when picking up the car:
74.1. printed or electronic Voucher (depending on the car rental company’s requirements);
74.2. valid driver's license from the Customer’s country of origin. It must be valid in the country where the car is being rented;
74.3. International Driving Permit. This may be required by some car rental companies as a supplement to the regular driver’s license;
74.4. a valid passport or valid ID card (if accepted by the car rental company);
74.5. a valid credit card in the same name and surname as the driver's license of the main driver with enough available funds to cover the security deposit;
74.6. other documents required by the car rental company and mentioned in the Voucher.
75. The Company shall not refund any amounts paid and assumes no responsibility if the car rental company refuses to provide the car to the Customer in any of the following circumstances:
75.1. no-show;
75.2. showing up late;
75.3. unused days;
75.4. failure to provide any document or item listed in paragraph 74 above;
75.5. the Customer is going to use the car against the terms of use established by the car rental company;
75.6. the Customer has been previously blacklisted by the car rental company;
75.7. the Customer arrives at the car rental desk under the influence of alcohol or drugs; or
75.8. there is a problem at the time of pick-up resulting in the Customer being denied the vehicle and the Customer does not call us at such time.
76. The Company is not responsible for any waiting time at the car rental company’s office.
77. The Customer is obliged to carefully read the rental agreement before signing it when picking up the rented car. The Customer’s signature means acceptance of all points in the agreement and all charges. If the vehicle offered by the car rental company at the destination does not match the vehicle booked by the Customer or if the Customer believes that the vehicle is not in roadworthy condition, the Customer must make a complaint to the car rental company immediately and, at the same time, notify the Company by telephone in order to fulfill their statutory duty to mitigate damage or arrange substitution of the vehicle or car rental company that is engaged in delivery of the Travel Package. Signs of use already visible when the vehicle is collected and damage to the vehicle must be recorded in a written inspection report in order to rule out the possibility of the Customer being blamed for causing them.
78. The Company is not responsible for any change in the Travel Package Price that occurs at the moment of the pick-up of the rented car due to the Customer’s acceptance of any optional services/extras (e.g. additional insurance, additional driver, etc.). If the Customer extends the rental period after it has already started, the car rental company can charge the Customer for all expenses related to extending the rental period. The car rental company will use local rates effective at that time.
79. The Company is not responsible for any change in the Travel Package Price or additional charge made by the car rental company that is the result of the Customer violating the rules of using the car established by the car rental provider.
TRAVEL PACKAGE WITH FULL COVERAGE (COUNTRY-BASED AVAILABILITY)
80. The Customer can upgrade Travel Package by adding Full Coverage into the Travel Package and Travel Package Price for the purpose to minimize Customer’s expenses that the Customer may be obliged to in case of loss or damage to the vehicle.
81. Full Coverage reduces (waives off) the Customer’s expenses for the amount of the deductible/excess deducted by the car rental company or charged by the insurance company in the event of damage or theft (subject to the restrictions in paragraph 88). The maximum amount of the Customer’s expense compensation under Full Coverage is indicated on the Voucher.
82. Full Coverage is not a financial or insurance product and the Company does not provide any insurance advice or consultation services or personalized insurance recommendations regarding the Full Coverage service. Company may provide the Customer with the information that might be needed to make an informed decision about rental and Full Coverage purchase.
83. Full Coverage does not replace a Collision Damage Waiver (hereinafter - “CDW”). The Company shall not assume any responsibility if a CDW is not included in the rental price and the Customer failed to provide valid proof of his/her own CDW as required by the car rental company and mentioned in the Voucher.
84. Full Coverage is complementary in its nature, and it does not replace or modify any existing insurance policy that the Customer or the Company already have, and it does not provide any guarantees or warranties beyond those expressly stated in these Terms and Conditions. Full Coverage does not alter or supplant any other insurance products independently procured by the Customer. The decision to select Full Coverage is voluntary and based on the Customer’s individual preferences and requirements.
85. Full Coverage can be added when making a booking and up to the scheduled pick-up time. The Customer can remove Full Coverage for a refund no later than the pick-up time by contacting the Company’s support team.
86. In most cases, the Customer is required to leave a security deposit to cover all or part of the CDW deductible/excess, the theft waiver’s deductible/excess (where applicable), and/or fuel. To do so, a valid credit card in the name and surname of the main driver must be presented when picking up the car. Customer that has added Full Coverage must also leave this deposit in full.
87. Full Coverage applies to risks indicated on the Website at the moment of purchase. These risks are also listed in the “My Booking” section on the Website and on the Voucher sent to the Customer. Full Coverage covers the following expenses related to the rented car up to the limits stated on the voucher:
87.1. Deductible/excess charge for damage;
87.2. Deductible/excess charge for theft;
87.3. Charges for repairs of the car’s body, undercarriage (excluding mechanical parts), tires, wheels, roof, windshield, windows, mirrors, locks, and hubcaps which are a result of a collision;
87.4. Towing expenses;
87.5. Taxi expenses directly related to the accident (excluding mechanical problems);
87.6. Costs directly related to losing the key(s) to or locking oneself out of the rented car (e.g., fees for a locksmith or delivery of a spare key);
87.7. Administrative fees relating to damage (excluding other administrative fees, for example, for traffic violations) and immobilization charges (charges to compensate the rental company for the loss of earnings while the car is being repaired).
88. Full Coverage does not cover the following:
88.1. Extras/ additional services (child seats, GPS, etc.);
88.2. Personal possessions or valuables;
88.3. Damages that occurred while the Customer was not complying with the terms of the rental agreement or local laws (driving under the influence of alcohol/drugs, putting the wrong fuel in the car, driving off-road, committing a traffic violation, etc.);
88.4. Hotel costs or other out-of-pocket expenses;
88.5. Cleaning costs or damage to the car’s interior or mechanical parts;
88.6. Bank fees or any differences in currency exchange rates;
88.7. Damages resulting from unforeseeable or uncontrollable events such as war, revolution, terrorism, strikes, or severe weather and natural disasters such as hail, floods, hurricanes, earthquakes, etc.; or
88.8. Third-party damages.
89. The Full Coverage process to reduce expenses:
89.1. In order to receive compensation under Full Coverage (to reduce Customer’s expenses), a request must be submitted through the My Booking page within 28 calendar days of the drop-off date or the date which the rented car broke down or was damaged or stolen. Electronic copies of the following documents must be provided:
89.1.1. The rental agreement that was signed when picking up the car;
89.1.2. Car rental company’s documented assessment of the car when it was picked up and when it was returned (check-list or pictures);
89.1.3. Invoice(s) from the car rental company showing the Customer was charged the deductible/excess, a portion thereof, and/or other fees;
89.1.4. The Customer’s credit card statement, bank statement, or receipt(s) showing payment of the above invoice(s);
89.1.5. The Customer’s PayPal or bank account details including the account holder's full name, account number/IBAN, bank name and address, SWIFT code, and any other information needed to make an international wire transfer (if the Customer provides incorrect bank details, a 50 EUR fee will be deducted from the compensation amount for each repeated wire transfer made before the correct bank details are received);
89.1.6. A detailed account of the incident (including photographic and video evidence, if possible); and
89.1.7. Written police report (if applicable to the accident or if mandatory based on the rental agreement).
89.2. It is the Customer’s responsibility to provide all of the above-mentioned documents to the Company.
90. The Full Coverage investigation and refund process following receipt of a request takes up to 28 calendar days. If additional information is required, the refund process may be extended for another 28 calendar days.
91. If the Customer does not contact the Company and does not provide any documents or evidence within the specified time period, the case will not be considered and no compensation will be paid.
92. In the event that the Customer has received compensation under the Company’s Full Coverage and becomes eligible for a future reimbursement by the car rental company (for example, it is determined that the Customer was not the “at fault” driver), the Full Coverage compensation amount received must be returned to the Company.
93. In the event of any fraudulent request or any fraudulent means or information has been used to obtain any benefit under Full Coverage, the service shall become void, the amount paid shall be forfeited, and any benefits requested and received must be returned to the Company.
JURISDICTION / APPLICABLE LAW
94. The Booking Agreement, Terms and Conditions, and email communication, which is an integral part of the Booking Agreement, are governed by the laws of Switzerland and will be interpreted in accordance with the laws of Switzerland. The courts of general jurisdiction of Switzerland shall have exclusive jurisdiction to settle any claim or dispute which might arise out of or in connection with these Terms and Conditions and the Booking Agreement.
AMENDMENTS OF THE CONDITIONS
95. The Company and the Customer agree on the procedure according to which the Terms and Conditions may be amended
96. The Company may notify the Customer of amendments to the Terms and Conditions and the effective date of said amendments on the Website, and the Customer shall be able to familiarize himself/herself with the Terms and Conditions in the new edition at least 14 (fourteen) days before the effective date thereof. The amendments also apply to those booked Travel Packages that occurred/entered into force before said amendments were made and that continue to exist on the effective date of the amendments. If the Customer disagrees with the amendments, he or she may, until the effective date of the amendments, submit a written notice to the Company regarding any disagreement with said amendments. If by the effective date of the amendments the Company has not received written notice from the Customer, the Customer shall be deemed to have agreed to the amendments and undertakes to comply with them.
97. The Company may immediately amend the Terms and Conditions unilaterally, without notifying the You thereof if the You do not qualify as a consumer in accordance with laws of Switzerland, if the particular amendment is in the Your favor, or if some technical corrections are made therein.
LIABILITY
98. In the event that the Company has expenses (also charged from the Company by car rental company or other third parties) related to the Customer’s misuse of the vehicle (damages or loss of the vehicle, speed fines, damages to other person’s property or health etc.) while using the Travel Package and which are not covered by the amount of the deposit, the Customer obligates to compensate to the Company all abovementioned expenses.
99. The Company is not responsible for commitments deriving from the car rental agreement concluded directly between the Customer and the car rental company (if any).
100. The Company is not responsible for (and is not under any obligation to verify) wrongly entered or misspelled email addresses or driver names or incorrect phone numbers or credit card numbers and any consequences arriving from that.
101. The Company is not responsible for compensating the Customer for damages or losses resulting from the actions or cars of the particular car rental company not complying with the rental agreement and/or applicable law.
102. Blocking and withdrawing of security deposits is initiated by the particular car rental company under its Rental Conditions, not the Company. Company assumes no responsibility in regard to blocking/unblocking or withdrawing of funds from the abovementioned Customer’s deposits.
103. For the convenience of the Customer, wording such as “cost of rental”, “Pay now” and “Payable on arrival” may be used on the Website. The term “Pay now” refers to the Travel Package Price part, which is paid at the moment of booking, the term “Payable on arrival” refers to the Travel Package Price part, which is paid to the car rental company at the moment of vehicle pick-up; extras, and additional services chosen by the Renter are all payable to the particular car rental company.
104. The Company has the right to transfer, delegate, outsource and/or subcontract some or all of its rights, obligations, liabilities and functions with authority to contract (including, but not limited to payment processing, documentation and invoicing operations, customer support, cancellation/modification functions etc.) under the Booking Agreement or/and the Travel Package or its part to its affiliates or any other party.
105. If it is necessary to change the booking, these changes may be made by the Company and the Company shall advise the Customer as soon as reasonably possible before the pick-up date and if the proposed changes are unacceptable, the Customer will be offered a full refund. However, in such circumstances, the Company shall bear no additional liability for any direct or indirect losses the Customer may suffer as a result of such changes.
TERMINATION
106. The Company reserves the right to terminate the Booking Agreement unilaterally and immediately by notifying the Customer via email in the following events:
106.1. information or indications have been received concerning the insolvency, bankruptcy or similar status or financial difficulties, as well as illegal actions, of the particular car rental service company;
106.2. error (technical or human) caused by the Company or car rental company, if the provision of the Travel Package Service becomes impossible or exceedingly difficult due to the respective error; or
106.3. the Customer has not passed a security check carried out by the car rental company or the Company.
107. If the Company terminates the Booking Agreement, the Company shall repay the Customer the Travel Package Price amount. The Company is not responsible for any other claims or complaints, including compensation of direct or indirect losses or non-material losses, any costs and expenses of the Customer in connection with this Booking Agreement and termination of the Booking Agreement and conclusion of any new Booking Agreement due to the terminated agreement.
DATA PROTECTION
108. The Company takes care that personal data of the Customer are processed according to the personal data protection requirements applicable in the European Union including the General Data Protection Regulation 2016/679. The Company ensures that the Customer’s personal data will be processed in accordance with lawful business purposes in order to provide the Service requested by the Customer. The Customer agrees that:
108.1. in order to provide the Travel Package, the Company is entitled to process and send Customer’s provided personal data and contact information (full name, date of birth, phone number and email address) and booking-related information to the car rental company in order to confirm the requested car rental service included into Travel Package;
108.2. the Customer’s email address will be used by the Company to send confirmation of the booking in the form of a Voucher, inform the Customer of their Booking credit balance and its expiration date, and inform the Customer about significant changes in these Terms and Conditions or any of Company's other policies;
108.3. the Customer’s phone number will be used by the Company to clarify questions regarding the booking, if they arise;
108.4. in order to provide the Service, the Company is entitled to process and send Customer’s provided personal data, contact information, booking-related information to Company’s affiliate parties.
109. Exhaustive information about our processing of Your personal data, which personal data we collect and process, for what purposes we use it, how long we store it, and other information is specified in the Privacy Policy on the Website. Under the term ‘we’ in this paragraph please consider all legal entities / affiliated entities mentioned in these Terms and Conditions in paragraph 33 and that are meant to mean DISCOVERCARS in mentionings on the Website.
110. The Website is allowed to make travel related (including car rental) arrangements. It is prohibited to use the Website for illegal purposes, namely, to make bookings that are speculative or false, or to obtain data on car rental companies or their car rental offers. By accepting these Terms and Conditions, the Customer agrees to use this Website only for its legal purpose.
CLAIMS AND COMPLAINTS
111. Customer’s complaints must be submitted through the My Booking page of the Website within 28 days of dropping off the car or the Company’s legal address, Baarerstrasse 110a, Zug, Switzerland, 6300. Any complaint must be received no later than 28 calendar days after the last date of the rental period. The Company will not process any complaints received after that period. If the Customer corresponds to the definition of a consumer pursuant to the Consumer Rights Protection Law of Switzerland, then the Customer shall have the right to submit a complaint within the term provided in that particular law.
112. If the complaint is related to the car rental company’s responsibilities, it should be addressed directly to the car rental provider and also to the Company. The Company will inform the Customer regarding how to proceed, if needed.
113. Claims will be reviewed and a decision will be made within 28 calendar days from the date the claims were received depending on the level of difficulty of the case.
114. If within a period of 21 calendar days there is no reply from the Customer to any of the Company’s emails, the case will be closed automatically without any resolution and/or compensation.
